1. Definitions

1.1 Agreement – This document outlining the terms and conditions of using TypeHello.

1.2 Client – A user of TypeHello services.

1.3 KOLM – The entity providing TypeHello services, legally registered as KOLM Michał Kołnierzak, listed in the Central Register and Information on Economic Activity of the Republic of Poland, with registered business address at ul. Ornecka 152P, 03-018 Warsaw, NIP 5361929091, REGON 367735680, Email: contact@typehello.com.

1.4 Electronic Service – A service provided electronically by KOLM to the Client via the TypeHello platform in accordance with these Terms.

1.5 Account – An electronic service, identified by an individual email address and password provided by the Client, containing resources and functionalities available in the KOLM telecommunication system, where the Client’s data and activity records are stored.

2. General Provisions

2.1 These Terms govern the use of TypeHello services and establish the legal relationship between KOLM and the Client.

2.2 The Privacy Policy available at typehello.com/privacy-policy is an integral part of this Agreement.

2.3 In matters not regulated by these Terms, applicable Polish law shall apply, particularly the Civil Code, the Act on Providing Electronic Services (July 18, 2002), and the Consumer Rights Act.

3. TypeHello Services

3.1 Account on TypeHello – The Client gains access to a dashboard, where they can create automation processes and manage their data.

3.2 Connecting Instagram Account – The Client can integrate their Instagram account with TypeHello to enable automation features.

3.3 Automation Setup – The Client can configure automated Direct Message (DM) responses and comment replies on Instagram. The automation process includes defining trigger keywords, selecting applicable posts, setting DM content, and defining comment responses.

4. User Responsibilities

4.1 While using TypeHello services, in particular when creating automations, the client must also comply with the Terms of Use of the Instagram application owned by Meta Platforms, Inc. The Terms of Use of Instagram can be found at www.instagram.com.

4.2 The Client is solely responsible for the content they generate and distribute via TypeHello, ensuring it does not violate any laws or third-party rights.

4.3 The Client must not:

• Use TypeHello for unlawful activities.
• Violate intellectual property rights.
• Harass, abuse, or threaten others.
• Submit false or misleading information.
• Upload or distribute malicious software.
• Engage in activities that could harm the platform or its users.

5. Limitation of Liability

5.1 KOLM is not responsible for:

• Any technical failures caused by third-party services that support TypeHello infrastructure, such as among others: hosting service provider or operation of the Instagram application, which is owned by Meta Platforms, Inc.
• Any damages resulting from improper use of the services by the Client.

6. Indemnification

6.1 The Client agrees to indemnify and hold KOLM harmless from any liabilities, claims, or damages arising from:

• Misuse of the services.
• Violation of laws or third-party rights.
• User-generated content that infringes upon intellectual property rights.

7. Governing Law and Dispute Resolution

7.1 This Agreement shall be governed by Polish law.

7.2 Any disputes arising from these Terms shall be resolved in Polish courts based on the registered address of KOLM.

8. Termination

8.1 KOLM reserves the right to suspend or terminate a Client’s account for violations of these Terms.

8.2 The Client may terminate their account at any time via the dashboard settings.

9. Amendments

9.1 KOLM reserves the right to update these Terms at any time. Clients will be notified of changes in advance.
